1. Unit Prices:

2. Quote Acceptance:

This quotation is open for acceptance without revision for a period of 30 days from the date of submission, after which time it becomes subject to variation. AWM Amaroo pricing is based on the design drawings we are provided at the time of the quotation. AWM Amaroo must be provided with the latest drawing revisions prior to the commencement of manufacturing. AWM reserves the right to charge for variations if the latest drawing revisions are not provided at sales order placement.

3. Veneer:

Should this order contain any natural veneer, AWM Amaroo does not accept responsibility or matching etc., unless each veneer section has been selected by the designer for each element. All finishes pricing is based on the supplied documentation.

4. Quantity:

AWM Amaroo reserves the right to change our tender price / or unit rates should the quantities vary from those originally tendered.

5. Retentions:

No retentions have been allowed for within our quotation / tender submission.

Only if a signed contract has been agreed by both parties to prior to works started.

Our practical completion is once AWM Amaroo have sign off on all our joinery and furniture not from the “builders “ practical completion.

6. Title of Goods:

Title and ownership of goods remains with AWM Amaroo until such time as payment is received in full.

7. Variations:

Variations to materials made after the quotation is signed and materials are in production may incur a delay in delivery and increased price.

8. Copyright of Design:

All designs, drawing, investigations etc. carried out specifically associated with the subject of the quotation remains the intellectual property of AWM Amaroo.

9. Site Access:

This quotation is submitted on the condition of having free access to the working area and for all work to be undertaken during normal trade hours. Hire of plant and equipment due to difficult access and specific site allowances are not included unless otherwise stated in this quotation. All delivery and installation is allowed during our normal working hours being Monday to Friday 7am to 3.30pm. Delivery or installation outside of these hours will incur additional cost.

10. Site Conditions:

A clear working area is to be provided for all work with the relocation or protection of existing furniture, fittings and personal items by others. Any existing furniture must be cleared prior to start of works.

11. Delivery:

Normally 4-6 weeks subject to confirmation at the time of receipt of order, and would be arranged to suit construction program and special requirements. Estimates detailed are based on present production commitments, availability of basic raw and fabricated materials, and therefore, may be subject to revision. Delivery times may be extended from the quoted period if the Buyer requests any variation to the drawings and finishes schedules.

12. Indemnities:

For either the intended purpose of AWM Amaroo products or anything other than their intended purpose, you agree to indemnify AWM Amaroo, its affiliates, employees, agents, contributors, third party providers and/or licensors from and against:

• all actions, suits, claims, demands, liabilities, costs, expenses, loss, injuries, death and damages (including legal fees on a full indemnity basis) incurred, suffered or arising out of or in connection with AWM Amaroo products;
• any direct or indirect consequences of accessing, or using the AWM Amaroo products by you, your employees, agents, contractors or visitors, regardless of being authorised or unauthorised; and/or
• any breach of any terms contained within this entire document referred as the AWM Amaroo Terms & Conditions.

13. Warranty Provisions:

13.1  Warranties are voided if any furniture is relocated by a party that is not an AWM Representative.

13.2   Warranties are not applicable for a staged job unless noted at time of the quote.

14. Floor Protection:

All floor protection is to be provided by others. All floor protection is to be removed prior to installation of workstations and storage. If AWM Amaroo be requested to remove or cut plastic floor protection covering in anyway, addition labour charges will apply. No responsibility will be accepted for any damage to floor covering caused.

15. GST:

Unless otherwise stated under basis of quotation prices do not include Goods and Services Tax. GST will be charged as a separate item on the invoice.

16. Damage in Transit:

Responsibility for onsite damage lies with the client. Notwithstanding any other provision in the Contract, the risk of the Goods passes to the Purchaser upon delivery. The Purchaser shall insure the Goods against loss or damage by fire, theft and other unusual risks for their full insurable value with a reputable insurer until full payment of the purchase price of the goods has been made to AWM Amaroo. Responsibility for damage in transit to destination within Australia will be accepted only where the goods are consigned by AWM Amaroo, provided it is reported on carrier’s way bill, or failing that, the way bill signed “Contents unexamined” and the damage reported both to the carriers or forwarding agents, and to ourselves within 7 days. Claims for damage, shortage or pilferage must be made in writing within 7 days of receipt of the goods by the consignee who should also immediately advise the forwarding agents.

17. Placement of Order:

The placement of an order against this quotation will be taken as an acceptance of the Conditions of Tender as stated and no deviation to these conditions regardless of ‘Conditions of Order’ will be accepted unless further agreed in writing by AWM Amaroo. Responsibility will not be accepted for delays and the consequences thereof arising from strikes, lock-outs, trade disputes, fires or other contingencies beyond our control. Upon acceptance of these terms and conditions and order received, AWM Amaroo are not obligated to accept any return of goods or cancellation of order due to change of mind.  The purchaser will be responsible for payment of goods once order is placed.

18. Payment Terms for COD Customers:

18.1   Our terms of trade require a 30 % deposit of total lump sum (including GST) to be    received with purchase order.

18.2   Custom made goods require a 50% deposit. The remainder (including any variations) is payable upon completion.

18.3   30% cancellation fee applies to standard goods.

18.4   Refunds are not applicable to custom made goods.

18.5   Notwithstanding the foregoing, the goods are at the entire risk of the buyer from the time of delivery.

18.6   We reserve the right to enter premises and repossess our goods at any time prior to full payment being received. Manufacturing will not commence until deposit funds are cleared.

• For an order less than $5000 a 100% upfront payment (prior to production) is required.
• For an order over $5000 a 50% deposit is required before works begin and the remaining 50% must be paid prior to goods being delivered to site.
• If the client wants to pay the deposit or upfront payment on credit card charge fees are not applicable, however, should a client wish to pay a final balance on credit card, then credit card charging fees will apply.
• Credit Card Payments:

The payment processing fee for credit card payments are as follows:

• MasterCard, VISA – 2.25%
• American Express – 1.75%

In addition to 18.9, credit card fee exemptions are made when full payment is received at time of order and that the total order does not exceed $50,000.00. Further, the total Order must not have multiple sales orders for one (1) delivery address within a six (6) month period.
