These Terms & Conditions (“Terms”) govern your access to and use of the website awm.net.au and any services, products, or transactions offered by AWM Amaroo. By using the Site, placing an order, or otherwise interacting with us online, you agree to these Terms.

If you do not agree to these Terms, you must not use the Site or purchase any products or services from us.


1. Definitions & Interpretation

  • Customer / you / your: Any individual or entity accessing or using the Site or purchasing products/services from us.

  • Product(s): The furniture, joinery, accessories, or other goods offered for sale via the Site or via contract.

  • Services: Any consulting, installation, delivery, or other services offered in relation to our Products or fit-out works.

  • Contract: The agreement between you and us for sale of Products or provision of Services, governed by these Terms.

  • Order: The request by you to purchase Products or Services via the Site or otherwise.


2. Eligibility & Use of Site

2.1 You represent and warrant that:

  • You are at least 18 years old (or of legal age in your jurisdiction) and capable of entering into these Terms;

  • You will use the Site in compliance with all applicable laws;

  • You will not use the Site in any fraudulent or harmful manner (e.g. uploading viruses, hacking, scraping content, infringing third-party rights).

2.2 We reserve the right to:

  • Refuse or cancel Orders you place at any time without liability (e.g. error in pricing, unavailability);

  • Suspend or terminate your access to the Site if you violate these Terms.


3. Orders, Pricing & Payment

3.1 Placing an Order:

  • To place an Order, you must provide accurate and complete information (name, contact, delivery address, etc.).

  • All Orders are subject to acceptance by us. We may reject or cancel Orders for any reason (e.g. stock unavailable, error in pricing, inability to deliver).

3.2 Pricing:

  • Prices shown on the Site are in Australian dollars (AUD) and exclude GST unless otherwise stated.

  • We may update prices at any time. Changes to prices will not affect Orders already accepted by us.

3.3 Payment:

  • You must pay via the methods we accept (credit card, bank transfer, etc.).

  • Payment must be made in full unless otherwise agreed.

  • If payment fails or is delayed, we may withhold delivery or cancel the Contract.

3.4 Taxes:

  • You are responsible for any applicable taxes, duties, or import fees (if you are ordering from outside Australia), unless otherwise agreed.


4. Delivery, Risk & Title

4.1 Delivery:

  • We will deliver to the address you provide.

  • Delivery times are estimates only; delays may occur.

  • You must inspect the Products on delivery and report any damage or defects as soon as possible.

4.2 Risk:

  • Risk in the Products passes to you upon delivery (i.e. when the Products are physically delivered to your premises or the delivery location).

4.3 Title (Ownership):

  • Ownership of the Products remains with us until we have received full payment in cleared funds (including any other amounts owing).

  • Until full payment, you must store the Products so they are identifiable and insured, and not dispose of or encumber them.


5. Returns, Refunds & Warranties

5.1 Warranty:

  • Our Products come with the warranties set out in our Warranty Policy (linked on the Site).

  • The warranty covers manufacturing defects under normal use for a specified period (as stated in the Warranty Policy).

  • The warranty does not apply to damage from misuse, neglect, improper installation, or normal wear and tear.

5.2 Returns & Refunds:

  • Because many Products are custom or bespoke, returns or refunds may be limited.

  • If a Product is defective or does not conform to the Contract, you must notify us in writing within a reasonable time (as defined in our Warranty Policy).

  • We may repair, replace, or refund, at our option, subject to applicable laws (such as Australian Consumer Law).

5.3 Australian Consumer Law:

  • If you acquire Products as a consumer (i.e. for personal, domestic or household use), certain statutory rights cannot be excluded, including guarantees under the Australian Consumer Law (ACL).

  • These Terms are to be read subject to those non-excludable statutory rights.


6. Intellectual Property

6.1 All content, logos, graphics, designs, trademarks, and other materials on the Site are owned or licensed by us (or our partners).

6.2 You may view, download, or print content from the Site for your own non-commercial use, but you may not copy, modify, reproduce, distribute, transmit, or exploit any content without our prior written permission.


7. User Content & Submissions

7.1 If you submit content to the Site (e.g. via contact or inquiry forms), you grant us a non-exclusive, royalty-free, worldwide license to use, display, reproduce, adapt, and publish that content in connection with our business.

7.2 You represent that any content you submit is lawful, non-infringing, and doesn’t violate any privacy or publicity rights.


8. Limitation of Liability & Indemnity

8.1 To the maximum extent permitted by law:

  • We are not liable for any indirect, special, incidental, punitive, or consequential loss (e.g. lost profits, loss of use).

  • Our total liability (for all claims) will not exceed the amount you paid us under the relevant Contract.

8.2 You indemnify and hold us, our officers, employees and agents harmless from any claim or loss arising from your breach of these Terms, negligent or unlawful use of the Products, or violation of third-party rights.

8.3 Nothing in these Terms excludes or limits liability to the extent such exclusion or limitation is unlawful (e.g. under the ACL).


9. Privacy & Data Protection

  • Our practices around collection, use, storage and disclosure of personal information are set out in our Privacy Policy (linked on the Site).

  • You agree that we may collect and use your personal data in accordance with that policy.


10. Changes to Terms

  • We may revise or update these Terms from time to time.

  • The “Last updated” date at the top will indicate the date of change.

  • Continued use of the Site or placing Orders after such changes means you accept the updated Terms.


11. Severability & Waiver

  • If any part of these Terms is found to be invalid or unenforceable, that part may be severed without affecting the validity of the rest of the Terms.

  • Our failure or delay in enforcing any right under these Terms does not constitute a waiver of that right.


12. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of New South Wales, Australia (or the state where your business is registered).

  • You and we submit to the non-exclusive jurisdiction of the courts in that state.

  • Prior to any court proceeding, parties should attempt good faith negotiation or mediation.

Warranty Policy

AWM Amaroo Pty Ltd (AWM Amaroo) warrants the products manufactured and supplied against failure due to defective materials or workmanship to the original purchaser only during the applicable warranty period set out below. Applied from the date of purchase from AWM Amaroo the warranty will cover the repair or replacement of AWM Amaroo manufactured (and/or assembled) products which are defective in materials or workmanship.

Please refer to the attached Product Warranty Certificate for a summary of the specific warranty periods that apply to your products.

Process for Claims

Claims for repairs or replacement can be submitted via the Service Request Form on our website. The situation will be assessed by our Service Team including installers and project managers with the appropriate follow-up action taken. This will either include over-the-phone instruction, or an experienced team member coming to the site for further assessment or replacement of components.

Conditions. This warranty applies to the:

  • Original owner/purchaser of the product only.
  • Structural and operational parts.
  • Normal use of the product in a general office/administration environment.

This warranty does not apply to:

  • Damage caused by a carrier other than AWM Amaroo.
  • Normal wear and tear, user abuse or acts or omissions of parties other than AWM Amaroo (including modification)
  • Damage caused by misuse or neglect.
  • Third-party fabrics, upholstery, foams, laminated board, or other third-party material are applied to products.
  • Products not installed by or under the auspices of a certified dealer of AWM Amaroo.
  • Dramatic temperature variations or exposure to unusual conditions.
  • Damage caused by Acts of God.
  • Changes in surface finishes, including colourfastness, due to ageing or exposure to light, It is the nature of veneer products to have variations in the grain pattern and wood colour. Any surface finish may be affected by exposure to sunlight and other elements which are part of the ageing process. Their material variations are not covered by this warranty.
  • Claims for any other associated costs from the end user, including claims for reimbursement for any work carried out by an unauthorised third party.
  • Natural variations occurring in wood and leather shall not be considered defects and AWM Amaroo does not guarantee the colourfastness or matching of the colours, grains or textures, or surface hardness of such materials.
  • Disassembly and re-assembly conducted by others.

Parts used to repair a product under warranty are covered to the end date of the original warranty period only.

AWM Amaroo makes no implied warranties other than those governed by the Trade Practice Act and NSW Fair Trading Laws. In no event will AWM Amaroo be liable for consequential, indirect, or incidental damages resulting from any cause. The warranty gives you specific legal rights including but not limited to State and Federal regulations. These rights may vary from State to State.
